The scope of the use of a 468(b) qualified settlement fund (“QSF”) was subtly expanded when a California court ordered the establishment of a QSF in a matter involving plaintiffs with a wide variety of different exposures to lead paint and duration of exposure. In doing so, the court determined that the same type of injury (lead paint exposure) was enough to consolidate all of the claimants into one QSF. Click here to view the order in the Burton v.
